Please read these terms carefully before purchasing the Untamed Shopify theme

1. Product Description

The Untamed Shopify Theme is a premium digital product designed for Shopify stores, specifically optimized for clothing and fashion retailers. The theme includes:

  • Complete Shopify theme files (.liquid, .css, .js)
  • Mobile-first responsive design
  • Instagram-style highlights feature
  • Built-in cart upsells and FOMO popups
  • Installation documentation
2. Theme Structure Delivery – No Images or Content Included

⚠️ IMPORTANT: PLEASE READ BEFORE PURCHASING

The Untamed Shopify Theme is delivered as a theme structure only. Demo images, sample content, product photos, and placeholder text shown in our previews or demo stores are NOT included in your purchase.

What You Receive:

  • Complete theme codebase (Liquid templates, CSS stylesheets, JavaScript files)
  • Theme configuration and settings schema
  • Section and block structures with customization options
  • SVG icons and essential UI assets included in the theme
  • Responsive layouts and design framework
  • Documentation for installation and configuration

What Is NOT Included:

  • Product images shown in demos or previews
  • Lifestyle photography and banner images
  • Sample product descriptions or copy text
  • Collection images or marketing graphics
  • Video content or media files
  • Any third-party stock photography

Why Shopify Themes Are Sold This Way:

This is the industry-standard practice for all Shopify themes, including those sold on the official Shopify Theme Store, ThemeForest, and other marketplaces. There are several important reasons for this approach:

  • Licensing Restrictions: Demo images are typically licensed exclusively for theme demonstration purposes only. These licenses do not permit redistribution to end customers for commercial use on their stores. Using them would violate copyright laws and stock image licensing agreements.
  • Legal Compliance: Distributing third-party images, even as "samples," could expose both the theme developer and customers to copyright infringement claims. Stock photography providers actively enforce their licensing terms.
  • Brand Customization: Every store has unique branding requirements. Demo content would need to be replaced with your own brand assets regardless, making pre-loaded content unnecessary and potentially confusing.
  • File Size Optimization: Including high-resolution demo images would significantly increase the theme package size, slowing down download and installation without providing any functional benefit.
  • Clean Installation: A structure-only theme ensures a clean starting point without leftover demo content that could accidentally remain visible on your live store.

What You Need to Provide:

After installing the theme, you will need to add your own:

  • Product images and descriptions (via Shopify's product management)
  • Banner images and promotional graphics
  • Logo and brand assets
  • Collection images and category graphics
  • Any lifestyle or marketing photography
  • Store policies, about us content, and other text copy

Image Recommendations:

  • Use your own original photography for best brand consistency
  • Licensed stock photos from providers like Unsplash, Pexels, Shutterstock, or Adobe Stock
  • Hire a photographer for professional product shots
  • Use AI-generated images where appropriate and legally permitted

Note: By completing your purchase, you acknowledge and agree that you understand the theme is delivered as a structural framework only, without demo images or sample content, and that this is standard practice across the Shopify theme industry.

3. License & Usage Rights

Upon purchase, you receive:

  • Single-site license for one Shopify store
  • Right to customize and modify the theme for your store
  • Unlimited use for your business purposes
  • Access to theme updates (if available)

Important Note on Updates: While lifetime license holders receive theme updates, certain premium features that require ongoing operational costs (such as Bear AI chatbot and similar subscription-based services) are exclusively available to monthly subscribers only. These features are not included in lifetime updates as they incur continuous third-party service costs.

Restrictions:

  • No redistribution or resale of theme files
  • No sharing with third parties
  • Use on single Shopify store only
4. Setup & Design Services – Terms of Engagement

⚠️ CRITICAL: SERVICES ARE SEPARATE FROM THEME LICENSE PURCHASES

Purchasing a theme license (whether Lifetime, Monthly, or Yearly) does NOT include any setup, design, customization, or content creation services. Services must be explicitly purchased as add-ons or engaged through written agreement. A theme license purchase alone entitles you only to the theme files and standard support as described in these terms.

4.1 Services Offered

Data Delves Private Limited ("Untamed," "we," "our," or "us") offers the following optional professional services as add-ons to theme license purchases:

Design My Store

A done-for-you store design service that includes:

  • Custom color palette and typography configuration aligned with your brand guidelines
  • Homepage layout configuration and section arrangement optimized for your product catalog
  • Key landing pages wired according to your SKU plan and category structure
  • Mobile-first optimization and performance speed checks
  • One sprint production timeline with priority support during the engagement

Exclusions: Copywriting, blog content creation, and product description rewrites are NOT included in this package.

Do It All For Me

A comprehensive done-for-you package that includes everything in Design My Store, plus:

  • 5 SEO-optimized, AI-assisted blog posts tailored to your niche
  • Product titles and descriptions for up to 20 SKUs
  • Image optimization and speed tuning across your store
  • Conversion Rate Optimization (CRO) review and merchandising recommendations
  • Go-live checklist and launch preparation
  • Post-handoff revision round and optional support call

4.2 How to Engage Services

Services may ONLY be engaged through one of the following methods:

  • Add-On Selection at Checkout: During the theme license purchase process, you may select a service package as an add-on. The service fee will be charged along with your license fee, and engagement will commence upon successful payment.
  • Written Communication: If you wish to engage services after your initial license purchase, you must contact us via email at support@buyuntamed.com or WhatsApp at +91 8368672969. Services will only be confirmed upon receipt of written acknowledgment from our team specifying scope, timeline, and payment terms.

No Implied Service Entitlement: Purchasing theme license(s) does not create any implied, assumed, or expected entitlement to setup, design, customization, content creation, or any other professional services. Services are strictly opt-in and must be explicitly purchased or agreed upon in writing. We are under no obligation to provide services that have not been purchased or formally agreed upon.

4.3 Payment Terms for Services

  • Advance Payment Required: Full payment for all services must be received in advance before work commences, unless explicitly agreed otherwise in writing by an authorized representative of Data Delves Private Limited.
  • No Work Without Payment: We reserve the right to delay or refuse to commence any service work until payment has been received and confirmed in our systems.
  • Payment Methods: Service fees may be paid via the same payment methods available for theme purchases (UPI, cards, net banking via Cashfree/Razorpay).
  • Written Payment Exceptions: Any deviation from advance payment terms (such as partial payments, milestone-based payments, or post-delivery payments) must be documented in writing and signed or acknowledged by both parties before work begins.

4.4 Timeline & Delivery

  • Timeline Communication: Project timelines, milestones, and expected delivery dates will be communicated to you in writing after payment confirmation and receipt of all required assets and information from your side.
  • Client Dependencies: Timelines are contingent upon timely provision of required materials from you, including but not limited to: brand guidelines, logos, product images, product information, store access credentials, and any other assets specified by our team. Delays in providing these materials will proportionally extend the delivery timeline.
  • No Guaranteed Deadlines: Unless explicitly agreed upon in writing, all timelines are estimates and not binding commitments. We will make reasonable efforts to meet communicated timelines but are not liable for delays caused by factors beyond our control.
  • Sprint-Based Delivery: Our Design My Store service operates on a sprint production model. The sprint will be scheduled based on our team's availability at the time of engagement.

4.5 Scope Limitations

  • Defined Scope Only: Services are limited strictly to the scope defined in the service package description and/or the written agreement. Any requests beyond the defined scope constitute additional work and may incur additional charges.
  • Revisions: Each service package includes a defined number of revision rounds as specified in the package description. Additional revisions beyond this limit may be billable at our discretion.
  • Third-Party Integrations: Services do not include setup or troubleshooting of third-party apps, payment gateways, shipping integrations, or any external services unless explicitly included in the scope.
  • Ongoing Maintenance: Services are one-time engagements. Ongoing maintenance, updates, or future changes after project handoff are not included and must be engaged separately.

4.6 Client Responsibilities

  • Provide complete and accurate brand guidelines, assets, and product information
  • Grant necessary access to Shopify admin and any required accounts
  • Respond to queries and feedback requests within reasonable timeframes (typically 48-72 hours)
  • Review and approve deliverables within agreed timelines
  • Ensure all provided content (images, text, etc.) does not infringe third-party rights

4.7 Cancellation & Refunds for Services

  • Before Work Commences: If you cancel a service engagement before any work has commenced, you may be eligible for a partial refund at our discretion, minus any administrative fees.
  • After Work Commences: Once work has commenced on a service engagement, no refunds will be provided. You will receive the deliverables for work completed up to the point of cancellation.
  • Client-Caused Delays: If a project becomes inactive for more than 30 days due to non-responsiveness or failure to provide required materials from the client's side, we reserve the right to consider the project abandoned. In such cases, no refunds will be provided, and reactivation may require additional fees.

Summary: By purchasing a service add-on or engaging services through written communication, you acknowledge that you have read and agree to these service terms. Services are strictly optional, require advance payment, operate within defined scopes, and are completely separate from theme license purchases. A theme license alone provides the theme files and standard support—nothing more.

5. Payment & Download

Payment is processed securely through Cashfree Payments. Upon successful payment:

  • Immediate access to download link
  • Maximum 3 download attempts
  • Download access valid for 30 days
  • Email confirmation with download instructions

All prices are in Indian Rupees (INR) and include applicable taxes.

6. Support & Warranty

We provide:

  • Installation guidance and documentation
  • Email support for technical issues
  • Bug fixes and compatibility updates
  • Support for 90 days from purchase date

Support does not include custom development or design changes beyond the theme's standard functionality.

7. Limitation of Liability

The theme is provided "as is" without warranty of any kind. We are not liable for:

  • Business losses or revenue impact
  • Compatibility issues with third-party apps
  • Data loss or website downtime
  • Customization conflicts

Our maximum liability is limited to the purchase price of the theme.

8. Governing Law

These terms are governed by the laws of India. Any disputes will be resolved in the courts of Mumbai, Maharashtra.

9. Subscription Trial, Cancellation & Refund Policy

7-day no-charge period: Applies to monthly and yearly subscription licenses.

Activation requirement: An active UPI Autopay mandate or card authorization is required to start the 7-day no-charge period. Without successful authorization, the subscription is considered cancelled and access will not be provided.

Cancel during trial (no charge): You must contact us at least 24 hours before the end of the 7-day period at support@buyuntamed.com or WhatsApp +91 8368672969. On cancellation during the trial, access is revoked immediately and no charge is made.

Cancel after trial (after first charge): Payments already captured are non‑refundable for the current billing cycle. You may cancel anytime to stop future renewals; access remains available until the end of the current billing period.

10. Changes to Terms

We reserve the right to update these terms at any time. Changes will be posted on this page with an updated "Last modified" date. Continued use of our services after changes constitutes acceptance of the new terms.

11. Showcase & Marketing

By using our theme, you grant Untamed and its affiliates a non-exclusive, worldwide, royalty-free license to display your store name, logo, screenshots, and a link to your storefront in our public showcase, marketing materials, case studies, and portfolio. We will not publish any private customer data or sensitive information. If you prefer that your store not be included in our public showcase, please contact us at support@buyuntamed.comand we will remove your store from future materials.
